Also, per the statutory factors it is a basis for the judge to find that primary placement with the mother is not appropriate as it is apparent that she has no intention of cooperating with any orders regarding alternate placement with the father. Court orders that the terms of Commissioner Frinzi's order be maintained with the exception that with father's consent the visitations will occur under the supervision of the social worker from LaCausa at his expense. It is strongly recommended by this Court that if this order which provides absolute protection for the child is not complied with that the Court strongly consider invoking the statutory provision regarding interference with placement as a factor in making the custody decision. sg

(continued) Per Deputy Boehm, who was in court, the Court must have an order to submit to the Sheriff's Department in order for them to pick up the child. Court ordered a missing person order producing the child to the court and upon production, contacting the father and putting the child in his care until a hearing is held before this court within 24 hours from the date the child has been picked up. SAME DAY: IN THE FEMALE HOLDING CELL ON THE 6TH FLOOR OF THE COURTHOUSE. Sames Appearances with the except of the State, who was not present. Court spoke to the petitioner, on the other side of a glass, in the holding cell, on the record. Petitioner turned her back to the court and remained mute. Court gave the petitioner the three options to purge herself: 1) allow guardian ad litem to investigate her home; 2) allow visitation to take place at a relatives home; 3) remain in custody until the child is located and placed with the father and a court hearing held the next day. Still no response by the petitioner. Court ordered a warrant for the child, and upon pick up of the child, the child be immediately released to the father. Court informed the mother he will give her the same three option on a regular basis to purge herself, and that she will not be forced to come to the hearing. Child is not present in court, nor any other family member of the petitioner. Petitioner stands MUTE, and refuses to speak. Matter here from last evening. Court places its findings on the record from last evening. During the hearing, mom abruptly decides to attempt to leave the courtroom when ordered to be seated. She was taken out of the courtroom forcefully by two female and two male deputies. Court states it will give mom three alternatives to purge herself: 1) Allow home investigation by guardian ad litem or social worker to determine visitations for the father; 2) to set up visits at the grandmother's home for the father; and 3) Court order child picked up and put in foster care so father may visit the child. Mom remains mute, and sent a message from the holding cell that she will not re-enter the courtroom. Court finds that the child has not been presented today and mom has not provided her address to meet her purge. Statements from Mr. Zellmer heard. It appears that mom resides at 2120 North 11th Street with her grandmother. Court ordered that the public defender's office be contacted for possible representation of the petitioner.Court ordered the guardian ad litem go to the holding cell and speak with mother. Guardian ad litem refused to do so without protection. She further refuses to conduct a home visit for fear of her safety. Court ordered mom to remain in custody until the child has been produced to this Court. Court ordered that a Missing Person (the child) Order be drafted by GAL and submitted for signature, so the Sheriff's Department may pick up the child.

Report came back from Jail Sergaent Babich that mom is refusing, and they would have need a cert team to get her out of the cell and transport her and prefer not to do this for safety reasons. Also present in court was Sergaent Boehm who reports that the jail are receiving numerous phone calls from people alledging to be from Alderman's office and other judicial offices, stating they are forming a sit in. She further reports that mom will not appear voluntarily wihout something in writting from the Court. Mom further states that the child is now out of state. Court is concerned with other individuals obstructing the court's order and there may be a need for the federal government to be involved. Court orders the Sheriff Department to find this child. Respondent may have the potential for kidnapping charges per the guardian ad litem. Court will draft an order summoning the petitioner to court on a contempt hearing to allow her once again to purge herself. This order will be served upon her by the Sheriff's Department in the jail. The Sheriff's Department may use their discretion as to whether it is safe to transport the petitioner to court. Court states it will not be intimidated by the phone calls and various threats, and that all parties involved must do what is necessary to protect their safety and the safety of all involved. Guardian Ad Litem presents a proposed pick-up order for the child to be located. Court also has some concerns about the mental state of the petitioner and suggested to the Sheriff's Department that the petitioner be closely monitored. Court will continue to have a public defender appointed for the petitioner, if she qualifies. slt

Matter here again to allow petitioner to purge herself one last time. Court states this is the last time petitioner will be brought back to court due to the difficulty of transporting her, and for the safety of the sheriff's department staff. For humanitarian purposes, Court is willing to allow mom to be released for the weekend to spend time with her other child, under the following conditions: 1) That she purge herself by surrendering the child; 2) by surrendering herself on or before 11:00am on May 21, 2007; and if petitioner has not met the following conditions, a warrant will go out for her arrest, without bail. Sergeant states that Detective Desotell located the child on Friday, May 18, 2007 at the 2722A North Richard Street address, which is the residence of the petitioner's parents. He was refused entry and states he could hear a child crying in the background, and he believes this is the child in question. Detective beleives in order to get a search warrant, the District Attorney's Office must be involved. There is a need now to move into criminal action, which must be commenced through the District Attorney's Office. No action taken by the Court. slt
