Motion hearing
Davis, J. Mac
Villwock, Gail
Additional Text:
Defendant Anthony R Stancl in court with attorney Craig M Kuhary. Brad D Schimel appeared for the State of Wisconsin. Attorney Kuhary withdraws motion to suppress statements. Court colloquies defendant regarding withdrawing motion to suppress. Court allows State to use defendant's statements since defense has withdrawn motion to suppress. Defense provides statements regarding an external hard drive that was seized by the State. Defense advised court that a New Berlin Police officer has damaged the hard drive and provided statements regarding whether the data can still be extracted from the hard drive. He also advised the court that there is a cost issue involved to trying to get that data recovered. Defense is requesting the Court order the State to do the recovery at their expense. State advised the court that a New Berlin Police detective is trying to restore the hard drive. State has no reason to think that this is exculpatory evidence and is not ready to concede that this should be at the State's expense. Court provides statements regarding the damaged external hard drive. Motion hearing scheduled for December 16, 2009 at 01:30 pm.
